SPECIAL TERMS AND CONDITIONS FOR THE “OFFICIAL JERSEY” BENEFIT FOR MADRIDISTA PLATINUM (LEGENDS) MEMBERS

These Special Terms and Conditions regarding the benefit of the official Real Madrid C.F. jersey for Madridista Platinum members (hereinafter, “Special Terms and Conditions”) exclusively govern the conditions inherent to the benefit of the official Real Madrid C.F. jersey (hereinafter, “Official Jersey”) included in the Madridista Platinum membership, as detailed in the Benefits of the General Terms and Conditions. These Special Terms and Conditions therefore complement the General Terms and Conditions of the Real Madrid Club de Fútbol Madridista Community (hereinafter, “Real Madrid C.F.”), which are available at this link and take precedence in matters related to registration, payments, renewals, cancellations, and withdrawal corresponding to the Madridista Platinum membership. 

1. Official Jersey – Activation Conditions

The benefit consisting of obtaining an Official Jersey is a conditioned and deferred benefit of the Madridista Platinum membership, whose activation and management are subject to the full compliance with the payment requirements indicated below, in accordance with the General Terms and Conditions of the Madridista Community (clause 3.3). 

a)  Annual payment: In the annual payment mode, the Official Jersey benefit is earned, activated, and managed exclusively after the effective collection of the full annual fee corresponding to the Madridista Platinum membership.

b)  Monthly payment: In the monthly payment mode, the Official Jersey benefit is only earned when the member has paid twelve (12) consecutive monthly installments, being activated and managed only after the effective collection of the fee corresponding to the twelfth (12th) month.

In the event of non-payment, chargeback, subscription cancellation, withdrawal from the program, or change of mode prior to the completion of the twelve (12) consecutive monthly installments, the right to obtain the Official Jersey will not arise, and the member will not have access to this benefit. 

c)  Nature of fees and absence of reimbursement: The fees paid, whether monthly or annually, exclusively compensate for access and enjoyment of the Madridista Platinum mode during the effectively covered period, along with the benefits associated with such status at each moment, and do not constitute, in whole or in part, an advance payment, deposit, or price for the Official Jersey.

Consequently, the failure to obtain the Official Jersey due to non-compliance with the payment requirements indicated will not generate any right to a full or partial reimbursement of the fees previously paid.

Each mode has its own pricing structure and benefits; the potential failure to obtain a conditioned benefit does not alter the validity of the fees accrued for the period effectively enjoyed. 

2. Madridista Platinum members under 14 years old

The Official Jersey benefit for Madridista Platinum members under fourteen (14) years of age includes the possibility of choosing among several versions of the Official Jersey adapted by age. These variants include the shipment of an armband and a ball (hereinafter, “Children’s Items”) in addition to the shipment of the Official Jersey, always subject to the Madridista Platinum members completing the selection and customization process outlined in Point 4 of this document, with such shipment occurring separately from the Official Jersey, in accordance with the operational schedule indicated in Annex II, and subject to the shipping and return policy established in said Annex.

3. Responsible party for customization, preparation, and shipment of the Official Jersey and scope

The management (selection, customization, preparation, logistics, and shipment) of the Official Jersey included in the Madridista Platinum benefit will be handled by Legends Hospitality España, S.L. (hereinafter, “Legends”) through this link, acting on behalf of Real Madrid C.F., which provides the necessary data for this purpose.

Legends is headquartered at Calle Poeta Maragall 1, 15th Floor - 28020 Madrid, Spain, is registered in the Madrid Commercial Registry, and has NIF B-88644299.

With respect to Madridista Platinum members, Real Madrid C.F. is solely responsible for any economic, administrative, or legal claims that may arise from this benefit, including the manufacture and shipment of the Official Jersey. 

3 bis. Allocation of responsibilities regarding Madridista Platinum members

Real Madrid C.F. will assume the role of sole responsible party for the benefit and compliance with these Special Terms and Conditions. Legends does not assume any obligation or responsibility towards Madridista Platinum members other than what is mandated by applicable regulations, acting exclusively as a logistics and customization operator.

Any economic, legal, or administrative claim related to the benefit must be directed to Real Madrid C.F. through the Club's official contact channels indicated in its General Terms and Conditions (contact email: madridistas.platinum@corp.realmadrid.com), without prejudice to the Club exercising any actions against Legends as agreed between both parties. The indication of Legends' contact channels for operational purposes does not alter this assignment of responsibilities. 

4. Selection and customization process

Once the applicable payment conditions are met, the Madridista Platinum member will access this link to select the size, version, and customization of the Official Jersey for the current season enabled for this benefit. Customization will be carried out in accordance with the options and technical, legal, and branding restrictions indicated in ANNEX I: Policy for Accepted Customizations – Madridista Platinum. Legends may reject customizations that infringe upon third-party rights, applicable regulations, or the policies of the Club and/or Legends.

The confirmation of customization by the Madridista Platinum constitutes definitive acceptance by the latter of the Official Jersey benefit. Due to the personalized nature of the product, exchanges or returns are not allowed for reasons of size, preference, or errors in the information provided by the Madridista Platinum, without prejudice to addressing manufacturing defects as indicated in clause 7. 

5. Production and Deadlines

The activation of the Official Jersey benefit is conditional on the effective payment of the Madridista Platinum subscription (annual fee payment or payment of twelve (12) consecutive months in the monthly payment plan), the availability of stock for the current season, and the proper receipt of confirmed customization. The preparation and shipping times described in the ANNEX II: Shipping and Returns Policy - Madridista Platinum are estimated and may be affected by supply chain issues, high campaign demand, special customizations, or force majeure. 

6. Shipping, Delivery, and Customs

The Official Jersey will be sent to the postal address indicated by the Madridista Platinum in the designated section of the process (“Where do you want to receive the Official Jersey”). It is the responsibility of the Madridista Platinum to verify the accuracy and validity of the postal address. For destinations outside the European Union, the Madridista Platinum will be responsible for paying any applicable tariffs, taxes, and customs fees in accordance with local import regulations, which will be required by the local authority or logistics operator at the destination.

In the event of absence, rejection, incorrect address, or failure to appear for customs clearance, delays, additional costs, or the return of the shipment may occur. If the shipment is returned for reasons not attributable to Legends, it will be communicated to the Madridista Platinum for reshipment purposes; any additional costs incurred may be charged to the Madridista Platinum, as applicable and as detailed in the ANNEX II: Shipping and Returns Policy - Madridista Platinum.

The risk of loss or damage is transferred to the Madridista Platinum at the time of physical delivery to the indicated address or, for shipments outside the EU, at the time of clearance and availability for customs formalities by the recipient. 

7. Address Changes and Transportation Issues

Before the Official Jersey is dispatched, the Madridista Platinum may request an address change through the contact form available on the website designated by Legends for managing this benefit or via email to customerservices@shop.realmadrid.com. If the Official Jersey order is already in transit, the modification may not be possible or may incur additional costs. In the event of a transportation issue, the Madridista Platinum must report it to Legends within the time frame indicated in the ANNEX II: Shipping and Returns Policy - Madridista Platinum from the delivery date or the expected delivery date, providing reasonable evidence as specified in the ANNEX II: Shipping and Returns Policy - Madridista Platinum

8. Returns, Exchanges, and Defective Products

As this is a personalized product, exchanges or returns are not allowed for reasons of size, preference, or errors in the information provided by the Madridista Platinum. The foregoing is without prejudice to consumer rights regarding non-conformity, manufacturing defects, transportation damage, preparation or shipping errors, or issues not attributable to the customer, in accordance with current consumer protection regulations. For illustrative purposes, cases of non-conformity will include manufacturing defects, personalization errors attributable to Legends (e.g., incorrect name/number/patches from what was confirmed), delivery of an incorrect size or product, and transportation damage. For applicable procedures and deadlines, see the ANNEX II: Shipping and Returns Policy - Madridista Platinum.

In such cases, the Madridista Platinum may request Legends, at no cost, to repair or replace (including new production and reshipment) the Official Jersey (or, where applicable, the armband or ball), unless the chosen option is impossible or disproportionate. Preferably, replacement with an equivalent product, subject to availability, will be offered. When repair or replacement is not possible, is disproportionate, or cannot be completed within a reasonable time and without significant inconvenience, the Madridista Platinum may request, at no cost: (i) a refund equivalent to the value of the benefit (retail price of the product published in the Real Madrid Official Online Store at the time the benefit is activated as established in clause 1 of these Terms) or (ii) the termination of the 'Official Jersey' or 'Official Jersey + armband + ball' benefit, with permanent cancellation of the same (and the corresponding change in subscription type) and the refund of an amount equivalent to the value of the benefit, as previously indicated. In both cases, Legends will arrange for collection and cover the return expenses and any associated logistical costs.

Procedure and Deadlines: The Madridista Platinum must report any issues related to the Official Jersey benefit through the contact email: customerservices@shop.realmadrid.com, providing reasonably required information (e.g., order number, product and packaging photos, description of the defect or damage, and delivery note or proof of delivery). Visible transportation damages must be reported within the time frame indicated in the ANNEX II: Shipping and Returns Policy - Madridista Platinum and, in any case, within a reasonable time from delivery. Non-conformities and manufacturing defects may be reported during the applicable legal warranty period from the time of delivery. 

Return Costs: when the return is due to non-conformity, manufacturing defects, transportation damage, or other reasons not attributable to the Madridista Platinum member, the collection/return and re-shipping costs will be borne by Legends. In any other case, no return or exchange will be allowed as the product is personalized.

This limitation does not affect the right to withdraw from the Madridista Platinum subscription, which is governed by the General Conditions of the Madridista Community and does not, under any circumstances, grant the right to return or exchange the personalized Official Jersey unless the aforementioned conditions are met.

9. Withdrawal from the Madridista Platinum Subscription

The right to withdraw from the Madridista Platinum subscription is governed by the provisions in the General Conditions of the Madridista Community (Clause 3.3.4) (withdrawal rights section) and, where applicable, by relevant regulations. Valid exercise of the withdrawal right for the subscription does not enable the return or exchange of the personalized Official Jersey nor does it create the right to its delivery if the payment requirements activating the benefit have not been met, all in accordance with the General Conditions of the Madridista Community.

 10. Data Protection

10.1 This specific condition refers solely to the processing of personal data for managing the selection, customization, preparation, and delivery of the Real Madrid Official Jersey benefit.  Consequently, in everything not expressly regulated in these Specific Conditions, the provisions of the “6. PERSONAL DATA” clause in the General Conditions of the Madridista Community apply. 

10.2 Roles and data sources in the processing of personal data for the selection, customization, preparation, and delivery of the Real Madrid Official Jersey benefit.

Real Madrid C.F. (the Club) acts as the data controller for the data of Madridista Platinum members. To manage the selection, customization, preparation, and delivery of the Official Jersey, the Club will share with Legends the strictly necessary personal data (identification, contact, and logistics data in the case of the annual subscription mode). Legends acts as the Club's data processor for these purposes.

10.3 Updating data by the Madridista Platinum member.

Before shipping, through this link the Madridista Platinum member will be allowed to review and update delivery data (e.g., postal address, contact person, and phone number) and any necessary logistical instructions. This data collection/update is carried out by Legends as the processor on behalf of the Club. The member guarantees the truthfulness and accuracy of the data provided or updated. 

10.4 Purposes and legal basis for processing personal data for managing the selection, customization, preparation, and delivery of the Real Madrid Official Jersey benefit.

The processing is carried out to manage the benefit included in the subscription (customized manufacturing, preparation, and shipment of the Official Jersey, incident management, and after-sales service), based on the execution of the subscription contract with the Club and, where applicable, the Club's legitimate interest in ensuring proper logistical performance and preventing fraud or abuse, without prejudice to applicable legal obligations.

10.5 Recipients and providers in the processing of personal data for managing the selection, customization, preparation, and delivery of the Real Madrid Official Jersey benefit. 

For service provision, Legends, in its capacity as the data processor, may grant access to logistics and customer service providers (carriers, warehouses, printers/customizers, support services, and management platforms), which will act as sub-processors in accordance with Article 28 of the GDPR and under the documented instructions of the Club. In the case of international shipments, the strictly necessary data may be communicated to customs authorities and operators at the destination for clearance and delivery. 

10.6 International transfers in the processing of personal data for managing the selection, customization, preparation, and delivery of the Real Madrid Official Jersey benefit.

When necessary due to destination or provider infrastructure, international data transfers outside the EEA will be based on adequacy decisions or, failing that, on adequate safeguards as provided in Articles 46 and following of the GDPR (standard contractual clauses or others), which can be consulted through the indicated contact channels. 

10.7 Data retention for managing the selection, customization, preparation, and delivery of the Real Madrid Official Jersey benefit. 

Data will be retained for the time necessary to manage the Official Jersey benefit and related incidents, and subsequently for the applicable limitation periods to address potential liabilities. 

10.8 Rights and contacts.

Madridista Platinum members can exercise their data protection rights at the postal address Avenida Concha Espina nº1, Madrid, Spain, CP 28036, or via email at oposicion@corp.realmadrid.com, and obtain more information about data processing in the Annex attached to these General Conditions or in our privacy notice at www.realmadrid.com/legal/politica-privacidad. For privacy inquiries related to processing carried out by Legends as a processor and, where applicable, regarding its own channel processes, use the contact channel indicated in its Privacy Policy [customerservices@shop.realmadrid.com]. The current privacy policies of the Club and Legends are available on their respective official websites. 

10.9 Additional information on data protection.

Additional information about data processing and current privacy policies is provided on the Club's subscription screens, in the General Conditions of the Madridista Community, and in Real Madrid's Privacy Policy, as well as in the logistical flow of Legends.

11. Madridista Platinum Support and Claims

Inquiries, issues, and/or claims related to subscription, payments, registrations, cancellations, and renewals for the Madridista Platinum membership are managed by Real Madrid C.F. through the official contact channels of the Club indicated in its General Terms and Conditions (contact email: madridistas.platinum@corp.realmadrid.com). 

Inquiries and issues related to the selection, personalization, production, shipping, and delivery of the Official Jersey are managed by Legends via this link for the management of the Madridista Platinum benefit and through their support inbox (contact email: customerservices@shop.realmadrid.com). Complaint forms are available to Madridista Platinum members in accordance with applicable regulations.

12. Modifications

Real Madrid C.F. may modify these Specific Terms in accordance with its General Terms and Conditions.

Legends may update policies published on their website (Personalizations, Shipping and Returns, Customs) for operational, legal, or service reasons, notifying updates on those pages and reflecting the date of the latest update. 

13. Applicable Law and Jurisdiction

These Specific Terms will be governed by Spanish law, without prejudice to mandatory consumer protection regulations and the applicable jurisdictions, where relevant.

ANNEX I: Policy on Permitted Personalizations - Madridista Platinum

Scope and Purpose

This policy governs the personalizations of the official jersey included as a benefit in the Madridista Platinum membership, managed through the Legends website. It complements the Specific Terms and Conditions of the benefit. 

Available Options

  • Name and number using the Club’s official fonts. Patches/licenses authorized by the Club and competitions. Patches are not available for children's items.
  • Limit: name up to ten (10) characters; numeric number with one or two (2) digits (00-99).

Prohibited Personalizations

Personalizations will not be accepted if they:

  • Include offensive, defamatory, injurious, obscene, violent, or discriminatory content (political, religious, racist, sexist, LGBTQ-phobic, etc.).
  • Infringe third-party rights (trademarks, copyrights, unauthorized third-party names).
  • Incorporate personal data (e.g., ID numbers, phone numbers, addresses) or references to unauthorized players/persons.
  • Violate the Club’s policies.

Review, Rejection, and Cancellation

  • Legends and/or the Club may review and reject personalizations that violate these terms. Members will be informed and, where applicable, requested to provide an alternative.
  • If a violation is detected after confirmation, Legends may cancel the personalization order and offer compliant replacement options.

Errors Attributable to the Customer vs. Legends

  • Errors caused by the customer (e.g., incorrect name/number entered) do not entitle the customer to exchange or return, as the product is personalized.
  • Errors attributable to Legends (e.g., name/number different from the confirmed one) will be corrected at no cost through new production/replacement.

Model and Season Window

  • The model, options, and patches available will align with the current season and may vary due to stock or licensing.

Intellectual Property

  • Distinctive signs, designs, and fonts are owned/licensed by the Club and third parties. Reproduction for commercial purposes is prohibited.

ANNEX II: Shipping and Returns Policy - Madridista Platinum

Scope

This policy governs the preparation, delivery, and management of issues/returns for items included as a benefit in the Madridista Platinum membership. For the Madridista Platinum variant for members under fourteen (14) years of age, it includes, in addition to the jersey, the separate shipment of an armband and a ball (“Children’s Items”). It is not an independent benefit. 

Shipping Eligibility

  • Annual payment: the jersey will be shipped after the annual fee has been successfully charged.
  • Monthly payment: the jersey will be shipped after the 12th month's fee has been charged, requiring twelve consecutive monthly payments. Non-payments/cancellations before the 12th month will not entitle the member to the jersey.

The “Children’s Items” for Madridista Platinum members under fourteen (14) years of age who have confirmed a variant of the Official Jersey that includes the ball and armband will be shipped subject to the active status of the subscription and depending on when the selection and personalization process of the Official Jersey, detailed in Point 4 of this document, was completed:

o   Children’s Items will be shipped in June if the Madridista Platinum member completed the selection and personalization process of the Official Jersey between October and March of the previous period.

o   Children’s Items will be shipped in December if the Madridista Platinum member completed the selection and personalization process of the Official Jersey between April and September of the same year. 

Estimated Timelines

  • Preparation (from eligibility + personalization confirmation): 10-14 business days.
  • EU transit: 2-7 business days.
  • Non-EU transit: 7-15 business days, subject to customs. Timelines are estimates and may vary due to campaigns, stock, special personalizations, or force majeure. Tracking will be provided.

Delivery Address and Changes

  • The member must verify/update their address before shipping on the Legends website.
  • Changes to the order while in transit may not be possible or may incur additional costs.

Transport Incidents

Communicate through the Legends form/email providing:

  • Order number and tracking.
  • Description of the issue.
  • Photos of the packaging and product (if applicable).
  • Proof of delivery/packing slip. Recommended notification deadlines:
  • Visible damage: within 48 hours of delivery.
  • Non-apparent damage: within 7 calendar days of delivery.

Returns, exchanges, and non-conformity

  • No exchanges or returns are accepted for size/preferences or for errors in data provided by the customer (personalized product).
  • Accepted at no cost when there is a lack of conformity (e.g., manufacturing defect, personalization error attributable to Legends, size/product different from the one confirmed, transportation damage): 
  1.  Main solution: repair or replacement (new production and reshipment) at no cost.
  2. If not possible, disproportionate, or unreasonable within a timeframe, remedies provided by consumer regulations will apply.
  • Since the jersey is a benefit, solutions do not entail a refund of membership fees, without prejudice to the provisions of the Club's General Terms and Conditions.

Costs and re-shipments

  • In cases not attributable to the customer, pickup/return and reshipment costs are covered by Legends.
  • Returns due to customer causes (incorrect address, repeated absence, unjustified rejection) may entail re-shipment costs.

ANNEX III: Customs and Tax Information - Madridista Platinum Delivery terms

  • Unless otherwise indicated, international deliveries are made under DAP/DPD terms: duties, taxes, and local fees are borne by the recipient.

Charges and management

  • The operator/authority may require payment of duties and taxes before delivery. Non-payment may result in delays, additional costs, or return of the shipment.
  • The recipient must provide the necessary data/documents for clearance (e.g., local tax ID).

Customs clearance times

  • Customs times depend on local authorities and can significantly extend delivery. Legends does not control these timelines.

Returns due to customs issues

  • If the shipment is returned due to non-payment, incomplete documentation, or failure to appear, re-shipment will be offered when possible; additional costs may be charged to the recipient.

Import restrictions

  • Some product/country combinations may be restricted or unavailable. The recipient must check their country's regulations.

Support and contact

  • The recipient must directly address carrier/authority requirements. Legends will provide reasonable coordination support.
