Legal bases for the competition: “PROMO USA TOUR PACK”

Participation in this competition implies the acceptance and compliance with the following conditions:

1.-THE ORGANISING COMPANY AND AIM

1.1. Real Madrid Club de Fútbol, hereafter: “the organiser” and/or “Real Madrid” has organised the following competition: “PROMO USA TOUR PACK” (hereafter “the competition”). Real Madrid Club de Fútbol, is a sports organisation, registered in Madrid, Avda. de las Fuerzas Armadas 402, 28055, Madrid. Tax Identification Number G-28034718.

1.2. The objective of the competition organised by Real Madrid is to draw one (1) pack consisting of one (1) pair of tickets for the International Champions Cup match between Real Madrid CF and Atletico Madrid on July 26, 2019 at MetLife Stadium in New Jersey, two (2) flight tickets in economy class to New York the day before the day of the game and back to their place of origin the day after the aforementioned game and two nights hotel in New York for two (2) people in a hotel of at least 3 stars chosen by the Club the day before the match and the day of the match.

If the winner lives near New York and does not need to fly to attend the match, Real Madrid would provide the winner with the most appropriate means of transportation to travel to New York the day before the match and return to their place of origin the day after the game. This could include, by way of example, two (2) standard class train tickets to New York the day before the match and back to their place of origin the day after that game.

1.3. The competition is regulated by these specific rules, which can be accessed on the app “PROMO USA TOUR PACK”. The mere fact of participation by any individual implies the unconditional acceptance of these rules.

1.4. All of the information relating to the competition (its conditions and legal basis, instructions about the way the competition works, its organisers, prizes and schedules) can be found in an advertising space for the consultation of these legal bases.

2.- ENTRY REQUIREMENTS

2.1. In order to enter the competition entrants must be over the age of fourteen (14) on the date on which the competition opens, and their personal information must be correctly filled out in the competition-specific form, which can be accessed via the advert.

2.2. To participate entrants must follow these steps:

- Enter the app “PROMO USA TOUR PACK””.
- Fill out the form with the personal information which is requested.
- Read and accept the legal basis and the data protection information.

2.3. In addition, the Real Madrid members and the holders of the Madridista card who prove their status in the reception of promotional communications for this competition may participate in this competition. Real Madrid members and the holders of the Madridista card will receive an email about the competition where, after identification of their Real Madrid member number or Madridista card number and password, they can take part in this draw with a double participation (Madridistas) and a triple participation (members).

2.4. For the purposes of the competition, only the entry forms of entrants to have filled out all of the obligatory fields with accurate, full and up-to-date information will be considered as being valid. Inaccurate information or forms submitted after the set deadline will not be accepted.

2.5. Entrants who do not meet all of the requirements included in these legal basis will not be allowed to win the prize.

2.6. The Directors and employees of Real Madrid C.F., or their direct family members, or the Directors or employees of intermediary companies cannot take part in the competition, be it directly or indirectly.

2.7. Entries must be made personally by the individual entering the competition, under no circumstances will entries made by third parties be accepted.

2.8. Participation in the competition is free.

3.- COMPETITION TIMELINE AND TIME ZONES

The competition is not restricted geographical and opens from 10:00 (GMT +1) on 23 April 2019 and closes at 23:59 on 2 June 2019.

4. THE WAY THE COMPETITION WORKS

4.1. To enter the competition, entrants must access the application “PROMO USA TOUR PACK” and complete the registration form accurately, fully and accurately.

4.2. In the case of Real Madrid members and holders of the Madridista card, as they are already participants identified by the Club, their participation in the draw will be done with a prior identification of the Real Madrid member or the holder of the Madridista card, the validation of your personal data in the memebr/Madridista participation application and the sending of them.

4.3. The legal basis of this competition are kept and notarized in the offices of the Madrid Notary, Mr. Cruz Gonzalo López Müller Gómez, Calle Padilla number 1, 28001, Madrid.

4.4. Amongst all participant in the competition, a draw will be made for: one (1) pack consisting of one (1) pair of tickets for the International Champions Cup match between Real Madrid CF and Atletico Madrid on July 26, 2019 at MetLife Stadium in New Jersey, two (2) flight tickets in economy class to New York the day before the day of the game and back to their place of origin the day after the aforementioned game and two nights hotel in New York for two (2) people in a hotel of at least 3 stars chosen by the Club the day before the match and the day of the match.

4.5. The draw for the prizes will be held, by random procedure, between 3 and 4 June 2019 before a Notary of Madrid to whom these Terms and Conditions have been deposited. Real Madrid reserves the right to modify at its convenience the date of said draw.

5. PRIZE WINNERS

5.1. At the end of the contest (detailed in part 3), through random draws held in the presence of the Notary of Madrid, the following winners and reserve winners will be chosen, according to the prize established in this promotion:

One (1) provisional winner.
Ten (10) reserve provisional winners.

5.2. Real Madrid C.F. will inform the winner of the results of the draw and how and when they will receive their prize via email or telephone on the email or telephone number indicated in the registration form. The winners will have twenty-four (24) hours to claim their prize.

5.3. In the event that the winners does not reply to the email or they do not get in touch to claim their prize within twenty-four (24) hours, or if they reject the first prize awarded in this competition, said prize shall go to the next reserve winner to have come out of the draw.

5.4. The winner may reject the prize, but under no circumstances shall the prize be exchanged for money.

6. INTELLECTUAL PROPERTY

Entrants to the competition freely grant Real Madrid C.F. any sort of rights which they may be entitled to in relation to the information presented for the competition through their profile on https://www.facebook.com/realmadrid, and in particular the rights of reproduction, distribution, communication to the public, divulgation, making it available to the public, as well as the right of adaptation, including on the telecommunication networks and the internet for everyone's consumption and its entry into the public domain, with the organising committee being able to grant and transfer this information via any medium and also allowing third parties to licence these rights.

7. CAVEATS AND LIMITATIONS

7.1. Under no circumstances do the pages or profiles of entrants represent Real Madrid C.F., and as such, Real Madrid C.F. is not responsible for the content published on them.

7.2 Real Madrid C.F. reserves the right to delay, cancel, change the rules, repeat or terminate the competition at any time in the event of exceptional circumstances, whilst informing of these circumstances in such a way so that they do not prove detrimental in any way to the entrants.

7.3 Non-compliance with any of the basis laid down here shall give the organiser of the competition full discretion to disqualify the entrant at any time; likewise, the organiser reserves the exclusive right to reject the right for entrants to take part, if they consider that the conditions established here have been infringed upon.

7.4 In the event that the organiser has reasonable suspicions that an entrant has committed fraud, manipulation, has been dishonest or does not meet the entry requirements, they shall refuse to award the prize which has been won or disqualify the entrant.

7.5 In the event of an error, a misunderstanding or conflict in relation to the way any element of the competition works, or with the behaviour of an entrant, the decision made by the organiser in this regard will be definitive and final.

7.6 The organiser reserves the right to take the necessary decisions to ensure that the competition runs smoothly, with these being expressly accepted by all entrants.

7.7 In no way shall the organiser by responsible for the non-compliance or any type of infraction relating to this competition, and shall not be held liable in the event of losses suffered by entrants caused by the prizes or any other aspects of the competition.

7.8 Likewise, the organiser shall not be held liable for damages suffered by an entrant arising from their enjoyment of the prize.

7.9 The entrant excludes the organiser of all liability and shall indemnify them against any claims as a result of the damages which may arise from activities carried out with the awarded prize.

8.- OTHER CAVEATS

8.1 The organiser reserves the right to use the names, surnames and the images of the entrants, to reproduce them and use them in any advertising and promotional activities related to the competition without this usage involving any right to payment or any type of benefits.

8.2 The organiser can use the names, surnames and images of the entrants in its web site and in other medium as it sees fit.

9.- PERSONAL INFORMATION

Data Protection Policy

The entity responsible for looking after your data is Real Madrid Club de Fútbol with legal residence at Avda. de las Fuerzas Armadas 402, 28055, Madrid. Your personal data will be dealt with with the main purposes of managing your participation in the competitions, including the awarding of the prizes, as well as for the sending of personalised commercial communications related to products and services related to Real Madrid.

In regards to the sending of commercial communications related to products and services related to Real Madrid, and provided that this is carried out by electronic means, will be legitimated in the satisfaction of legitimate interests of Real Madrid, in accordance with article 21 of Law 34/2002, of July 11, for services of the information society and electronic commerce, as well as the European Regulation of Electronic Commercial Communications. You can always oppose this through contact with the Real Madrid Data Protection Office in the email that we indicate below: protecciondedatos@corp.realmadrid.com.

Additionally, and as long as you give us your consent, Real Madrid will proceed to communicate your personal information to collaborators and sponsors of the club for the development of commercial activities by them (via email, mailing, fax, SMS, email and any telematics means) of a general nature or adapted to their personal characteristics. We also inform you that Real Madrid reserves the right not to use the content published by the participants when said content is inadequate or offensive. In no case will Real Madrid take responsibility for the content published by the participants, being the participants the only ones responsible for the damages and losses that the inappropriate content of the profiles could cause Real Madrid or any third party.

In the same way, given that the draw is made before a notary, the participant is informed that their personal data will be communicated to the certifying Notary, and that the aforementioned data will be included in a notarial certificate that will certify the correct execution of the draw. This treatment will be legitimized in the satisfaction of legitimate interests of Real Madrid. At all times, the participant may object to this treatment through contact with the Real Madrid Data Protection Office through the address provided above.
